Thanet District Council has been fined £250,000 after one of its workers was left with permanent injuries after being diagnosed with Hand Arm Vibration Syndrome, also referred to HAVs.

Hand Arm Vibration Syndrome is usually brought on by repeated and prolonged use of vibrating machinery, and employers have a responsibility to ensure that workers use safe working practices to avoid the development of the condition. Symptoms of HAVs can include tingling, numbness, pins and needles and constant or frequent pain in the hands. The condition can severely affect sufferer’s sleep, and can make it very difficult or impossible to grip or pick up small items.

In this case the worker was often spending up to 6 hours per day using a range of powered equipment including lawn mowers, strimmers and hedge-cutters, depending on the season. He was not under any health surveillance and was not informed about the risks, or how to report any concerns. In addition, the council had failed to take steps to eliminate or control exposure to the risks of HAV, or even to educate employees as to the potential dangers of working with vibrating equipment.

Speaking after the case, the HSE’s Principal Inspector said: “Hand Arm Vibration is a serious disease that impacts on people’s lives and impairs their ability to work. It is entirely preventable but once the damage is done it is permanent. Any business, council or employers can learn from this case. If you have workers who use heavy machinery you need to ensure you properly manage the risks from HAVs, control or eliminate the exposure and train them so they can identify the symptoms.”

When the investigation began, the council was issued with an improvement notice instructing them how to begin to rectify the problem. When appropriate health surveillance was implemented, a further 15 cases of HAVs were brought to light, illustrating just how common the condition can be if the proper training and resources are not put in place.
